OBTAINING PERMISSION FOR AIRSPACE USAGE

In case of planning UAS flights over state aviation facilities (aircraft parking lots, warehouses, buildings, etc.) at joint aerodromes (Vasylkiv, Vinnytsia (Gavryshivka), Zaporizhia, Ivano-Frankivsk, Kanatove, Kyiv (Boryspil), Kyiv (Zhulyany), Kolomyia, Kramatorsk, Kulbakine, Lutsk, Lviv, Odessa, Odessa (Shkilny), Ozerne, Poltava, Uman, Kherson (Chornobaivka), Chernihiv) and Dnipro aerodrome, additional approval for such flights shall be obtained from the authorized persons of the state aviation entities based at the mentioned aerodromes, or its immediate / direct superiors.

In the event of necessity to submit application and obtain permission for airspace usage, as prescribed by the Aviation Rules of Ukraine “Rules for usage of the Ukrainian airspace”, unmanned aircraft operators need to:

 

register in the database of Ukraerocenter;

 

after confirmation of registration, submit an application for airspace usage in “RUN” format to the Ukraerocenter in accordance with Annex 3 to these Rules. The Ukraerocenter is processing applications for the airspace usage only from airspace users, who are registered in the database of Ukraerocenter;

 

add to the application for airspace usage copies of permits/approvals (if necessary).

 

After applying for airspace usage, airspace users receive an e-mail with information on the inclusion of the application in the airspace usage plan, which is a permission to airspace usage, or the prohibition of the airspace usage with the specified reason for the prohibition.

 

Information on including an application in the airspace usage plan for obtaining permission for airspace usage can be obtained from the Ukraerocenter after 18:00 Kyiv time by telephone +38 (044) 351-62-90 (pre-planning department) or from the senior navigator of the relevant ATM center, within the area of which such flights of unmanned aircraft will be operated.

 

In the case, when Rules prescribe a necessity of submitting an application for airspace usage, airspace users can operate unmanned aircraft only after: obtaining permission for airspace usage (i.e. after receiving information about including an application for airspace usage in the airspace usage plan); request and receive of conditions for airspace usage; informing control units of Air Forces of the Armed Forces of Ukraine and, if necessary, the units of the State Border Guard Service of Ukraine.

 

Airspace users, who perform flights of unmanned aircraft based on the submitted application and the obtained permission for airspace usage, are obliged to organize operational telecommunications (including mobile) with:

 

a senior air traffic controller (senior navigator) of the ATM center, within the area of responsibility of which an unmanned aircraft will be operated;

 

the control units of Air Forces of the Armed Forces of Ukraine, within the area of responsibility of which an unmanned aircraft will be operated;

 

air traffic services units, which provided general and operational air traffic – in case of flight  operation within the area of his responsibility;

 

the units of the State Border Guard Service of Ukraine - in the case of flights within a zone with a special regime for the airspace usage, established along the state border of Ukraine 25 km wide into the territory of Ukraine, in case of non-compliance with the requirements of subparagraphs 1 - 8 of paragraph 4 of section II of the Rules or when the unmanned aircraft weight exceeds 20 kg.

 

For the purpose of informing about the activities for airspace usage (paragraph 5 of section II and paragraphs 8-10 of the section XII of the Rules) an airspace user shall:

 

not later than 1 hour before the beginning of the unmanned aircraft flights, make a request for permission and conditions of airspace usage, as determined by the ATM center, within the area of which the unmanned aircraft will be operated, or the Ukraerocenter. Such airspace user shall receive a reply to its request no later than 30 minutes before the beginning of the flights;

 

in 10 minutes before the scheduled start time of flights inform the control unit of Air Forces of the Armed Forces of Ukraine and the ATM center, within the areas of responsibility of which an unmanned aircraft will be operated, about the start time of unmanned aircraft operations, about their cancellation or postponement of the beginning of the flight;

 

within 5 minutes of the actual time of the onset of the following events – inform about the end of flights or interruptions in flights longer than 1 hour;

 

inform immediately - in the event of an emergency situation with the unmanned aircraft, aviation incident, a serious incident or incident, an emergency (in particular, the loss of the control line and control or the unmanned aircraft moving into an uncontrolled flight), acts of unlawful interference in the control of unmanned aircraft and cases with signs of violations of the order of Ukrainian airspace usage.

 

Note. When resuming unmanned aircraft flights after an interruption in flights or after their postponement of the beginning, the conditions of airspace usage are requested and the informing is provided in the order described above.

 

In order to perform flights within the zones of temporary restrictions of the airspace usage, established in accordance with NOTAM, the unmanned aircraft operator shall, additionally, no later than 1 hour before the beginning of unmanned aircraft flights, request through the Ukraerocenter (tel. +38 (044) 351-59-92) a permission for such flights from the authorities, in the interests of which these restrictions have been established.

 

If, for the purpose of unmanned aircraft flights, it is planned to activate zones of temporarily reserved airspace (UKT zones), flight restriction zones (UKR zones) and hazardous zones (UKD zones), an application for the airspace usage of these zones shall be submitted by a legal entity/individual, in whose interests the specified zones are established.

For submission of applications and obtaining permissions for airspace usage, users of airspace usage need to register in the database of Ukraerocenter. For registration, please send an e-mail with the subject "Registration of airspace user" to: predplan@uksatse.aero in the form shown below.

  1. The preferred ORGNID (the airspace user identifier is the alphanumeric designation, that UAS operator will later indicate when submitting applications for the airspace usage), which includes no more than 10 characters.

Notes. If the airspace user identifier is already assigned to another physical/legal entity, Ukraerocenter will be asked to specify another identifier.

  1. FULL NAME natural or legal person UAS operator.

For example, Bily Aleksandr Volodymyrovych or CJSC "Voltamper".

  1. Certified aerodrome, which is the main point of departure of the UAS, its full name and, in brackets, a four-letter indicators (if available).

Notes. It is strongly recommended to use Ukrainian domains for submission of applications on airspace usage. E-mails from the Russian domains ".ru", ".rf" and similar to them will not be processed.

General provisions for applying for airspace usage by airspace users

Application for airspace usage is submitted by e-mail from the registered e-mail address of the unmanned aircraft operator to the Ukraerocenter on the day before planned flight operations no later than 12.00 UTC (which corresponds to 14:00 Kyiv time during winter period in Ukraine and to 15:00 Kyiv time during summer period in Ukraine) to the following e-mail address: predplan@uksatse.aero or by fax +38 (044) 234-03-99.

 

Email requirements for application for airspace usage:

 

the subject of the email indicates the type of application – “RUN”;

 

an application in the format “RUN” must be displayed in the text of the e-mail;

 

only one text application may be placed in the e-mail (the remaining applications in the letter will not be processed);

 

it is forbidden to add any attachments to the e-mail.

 

In case it is required to add copies of permissions/approvals to the application for airspace usage, such copies shall be sent to the e-mail address: navigator@uksatse.aero or by fax to +38 (044) 351-59-62 (during working hours: Mon-Thu 09:00-18:00, Fri 09:00-16:45) or nach_zminy@uksatse.aero or by fax to +38 (044) 351-59-92 (H24).

 

After 18:00 Kyiv time information on including an application in the airspace usage plan can be obtained from the Ukraerocenter by telephone +38 (044) 351-62-90 (pre-planning department) or from the senior navigator of the appropriate ATM center, within  the area of which flights of unmanned aircraft will be operated.

 

In case of receiving of an application for airspace usage without all necessary permissions/approvals (in case they are required), the specified application will not be processed by Ukraerocenter and the submitter will receive a prohibition for airspace usage.

 

In cases where the unmanned aircraft operator cannot independently determine which permissions/approvals are necessary for the airspace usage, an application in RUN format is sent to the email address: navigator@uksatse.aero or by fax +38 (044) 351-59-62 10 days before the planned date of the unmanned aircraft operation.

 

The responsibility for obtaining the permissions/approvals required for the unmanned aircraft operations belongs to the unmanned aircraft operators.

"RUN" type application format for airspace usage

An explanation of the fields of “RUN“ type application for the airspace usage is given in Annex 6 to the Rules:

Notes.  In all fields except COMMENT, do not add or remove spaces, because this is important for the correct processing of your airspace usage application by an automated system. The COMMENT field will be proceeded by a person, in this case there are no rules for blank spaces. In case of airspace usage activities within a few days, you can submit a “RUN” type application for a few days ahead. In this case an application is submitted for each of these days separately. The geographical coordinates in the first and last terms of the LALG field must match (thus, a closed figure is formed when describing the zone).

The contacts of the ATM units, control units of Air Forces of the Armed Forces of Ukraine, the units of State Border Guard Service of Ukraine are provided for the organization of operational communications during unmanned aircraft flights based on permission to airspace usage.

 

Please note that:

 

the senior air traffic controller (senior navigator) of the appropriate ATM center has complete information regarding established prohibitions and restrictions of airspace usage within the area of his responsibility only.

 

informing by the unmanned aircraft operator of control units of Air Forces of the Armed Forces of Ukraine is carried out in accordance with their areas of their responsibility;

 

senior air traffic controllers (senior navigators) of ATM centers, specialists of the control units of Air Forces of the Armed Forces of Ukraine and the State Border Guard Service of Ukraine do not provide advice/information about the order of submitting and filling out applications for the airspace usage, the order of obtaining by unmanned aircraft operators permits/approvals from individuals and legal entities;

 

the contact details of the administrations of airports, heliports and airfields are shown on the map of the zones of restrictions and restrictions of use of airspace;

 

the contact details of the administrations of airports, heliports and airfield are given on the map of the “Zones of prohibitions and restrictions of airspace usage”;

 

contact data of administrations of state aviation aerodromes, military training ranges and shooting ranges; legal entities in which interests restricted areas are established can be obtained from the senior air traffic controller (senior navigator) of the ATM center within his area of responsibility.
